Terms and Conditions

AMERICAN GUARDIAN TRANSPORT LLC agrees to have the freight described on the quotation dispatched on or about the dates requested. We will find a licensed Carrier (agent/driver) to fulfill the terms and conditions of this agreement. Please note that we do not guarantee a specific pickup or delivery date.

AMERICAN GUARDIAN TRANSPORT LLC is a licensed and bonded property broker. We are responsible for booking the shipment of freight with a licensed and insured Motor Carrier, who will handle their own damage claims. It may take a few weeks to process your claim, as the drivers must return to their terminals with the original bill of lading condition reports. AMERICAN GUARDIAN TRANSPORT LLC does not transport your freight/shipment or ensure its transportation. We provide the service of finding a licensed (by the Dept. of Transportation) and insured Carrier.

Carrier’s responsibility begins when the shipper or shipper’s designated person signs the bill of lading at pick up, and terminates when the shipper or shipper’s designated person signs the bill of lading at delivery. AMERICAN GUARDIAN TRANSPORT LLC must be notified if the shipper or designated person is unavailable for pickup or delivery.

AMERICAN GUARDIAN TRANSPORT LLC. Will not be responsible for demurrage at any port facilities.

AMERICAN GUARDIAN TRANSPORT LLC does not guarantee transport by any specific driver/carrier. Traffic and weather conditions may affect transit times and are not our responsibility or that of the carrier. We will ensure your cargo arrives safely.

All freight to be delivered with any balance due shall be paid at delivery by CASH, MONEY ORDER, or CASHIER’S CHECK ONLY (US funds), unless specified otherwise by your dispatch freight agent. Should delivery be attempted after notification (2 to 12 hours voice or text notification to phone provided by shipper) and shipper or shipper’s designated person does not have proper funds or is unavailable to receive delivery, freight will be taken to and left at the nearest terminal at the discretion of the carrier, where the shipper will have to retrieve and pay for storage and/or re-delivery fees.

AMERICAN GUARDIAN TRANSPORT LLC or its agents will not be responsible for vandalism, tire blowouts, or acts of God (fire, flooding, hail, sandstorm, tornadoes, earthquakes, icy roads, etc.) during transport. Shippers should maintain their own insurance for these reasons. Enclosed transport is available at a higher price if necessary to ensure the condition of the shipment. Please note that insurance does not cover tires or mechanical issues for drive-aways or towable units.

If damage should occur, all money owed for transport must be paid to initiate a claim. Damage must be noted in the proper place on the bill of lading and signed by the driver and shipper, regardless of weather or time of day. Signing the bill of lading without any notation of damage verifies that the shipper or his agent has received the said freight/shipment in good condition and that AMERICAN GUARDIAN TRANSPORT LLC and its agents are relieved of any further responsibility. The Shipper or Shipper designated person MUST check freight/shipment thoroughly.

AMERICAN GUARDIAN TRANSPORT LLC and its agents must be notified of any damage by phone within 12 hours of delivery. The shipper must submit in writing a description of damage, clear pictures, and 2 estimates within 10 days of receipt of said freight directly to the designated carrier for any resolution to be initiated. AMERICAN GUARDIAN TRANSPORT LLC will support you in this effort should such a problem occur, but in no way will AMERICAN GUARDIAN TRANSPORT LLC accept any responsibility for any negligence of the assigned carrier.

The Shipper specifically waives any rights to judicature of this matter at any location. AMERICAN GUARDIAN TRANSPORT LLC can only be liable for up to the amount of the deposit located on your quotation. In no case can AMERICAN GUARDIAN TRANSPORT LLC be held liable for the designated carrier’s damage. AMERICAN GUARDIAN TRANSPORT LLC will provide carriers insurance certificate and carrier information should any controversy arise.

If you place an order with us, you will need to provide a time frame of 7 business days from the first available pick-up date for AMERICAN GUARDIAN TRANSPORT LLC to dispatch the freight on quotation. You have the option to cancel any time prior to your shipment being assigned to a transporter. You will be charged a $250.00 administration fee. The remainder of your deposit will be refunded (minus transaction fees if a credit card is used for the deposit). If your shipment is booked with an assigned carrier before you email/fax your cancellation, you will forfeit your deposit amount. CHARGEBACKS ARE NOT ALLOWED.

By submitting your order online, you acknowledge that you are placing the order and accept our terms and conditions, as found here. This is understood to be in lieu of your physical signature. Whether you send a faxed check to AMERICAN GUARDIAN TRANSPORT LLC, type your credit card information, or book your order with us by texting/calling one of our representatives, you are agreeing to these terms and conditions.

Customers must make their freight/shipment available during the transport time. If the shipment becomes unavailable at any time after the order has been placed and a carrier has been assigned, AMERICAN GUARDIAN TRANSPORT LLC reserves the right to cancel the order with no refund of the deposit/reservation fee. Please note that neither AMERICAN GUARDIAN TRANSPORT LLC nor its agents shall be responsible for the following:

  • Damage caused by fluids or objects flying up from the roadway, or out of the sky.

  • Damage not detected at pickup location due to poor weather or lighting conditions.

  • Damage caused to the shipment during pick up of load.

  • Damage caused to the shipment during drop off unload.

  • Lost or stolen items are not the responsibility of AMERICAN GUARDIAN TRANSPORT LLC.
